Services
Working primarily in the greater Washington, D.C. area, Fair Wind Resolutions offers dispute prevention and resolution services to businesses, government entities, schools, community groups and individuals. Fair Wind Resolutions can provide services in all types of matters, from complex class actions to multi-party regulatory cases to emotional employment or family matters. Amy Wind has particular expertise in employment cases and multi-cultural matters, as well as situations that require unusual creativity or sensitivity to the parties.
Mediation
Individuals and organizations locked in troubling disputes can benefit from engaging a neutral person -- skilled in negotiation, communication and conflict analysis -- to help them consider their goals and alternatives, and negotiate a resolution. For the past 25 years, Amy Wind has served in that role in hundreds of disputes, mediating in such diverse settings as complex federal cases at both the trial and appellate levels; class actions and multi-party matters; statutory and regulatory challenges; divorces and custody disputes; criminal and juvenile cases; internal workplace strife; and community disputes. Fair Wind Resolutions provides mediation services, in litigation and pre-litigation as well as informal settings, in both English and Spanish.
Arbitration
Parties in conflict often seek arbitration as a way to resolve their dispute, either because it is required by contract or because they prefer to seek a decision through confidential, binding arbitration. Amy Wind is an experienced arbitrator who has been selected to arbitrate in private-sector employment disputes, complaints for the National Association of Securities Dealers, and hearings before the Office of Citizen Complaint Review of the D.C. Metropolitan Police Department. Fair Wind Resolutions provides an expedited litigation process under procedures agreed-upon by the parties, with or without a formal written award.
Facilitation
Fair Wind Resolutions offers groups and organizations the option of facilitation, a process by which an outside person (usually a trained neutral), is invited by a group or groups to help them discuss their issues, and then set and achieve their goals. Amy Wind worked for two years facilitating agreements between liberal and conservative organizations related to race relations and affirmative action, and has facilitated several lengthy series of conversations within school and church communities. Fair Wind Resolutions provides facilitation services to organizations wishing to work on the group’s goals and dynamics.
Workplace Consulting and Investigation
Employers sometimes need a qualified outside person to make confidential inquiries to determine the source and scope of internal employee issues, and to gather facts regarding employee claims. With nearly four decades of experience as an employment lawyer and mediator of employment disputes, Amy Wind knows how to investigate concerns about systemic issues of racial and gender discrimination, sexual harassment and retaliation; make recommendations where appropriate; and train employees on ethics, legal requirements, and conflict resolution strategies. Fair Wind Resolutions provides investigation services for generalized workplace issues, particular incidents or claims, or both.
Relationship Building
Sometimes individuals or groups jointly desire to create or improve their relationship, but are unable to do so because of prior negative interactions. Fair Wind Resolutions provides relationship-building services, including stakeholder interviews, needs identification, and individual and group meetings that inspire and sustain positive communications and relationship development.
Training
Fair Wind Resolutions provides customized curriculum design and stand-up training in basic and innovative dispute resolution, appropriate conduct and cultural competence in the workplace, anti-discrimination laws and requirements, and court-sponsored mediation design and practices.
